The hierarchy of titles, which decides everything

Indonesian land rights are ranked: Hak Milik (freehold, Indonesian citizens only), Hak Guna Bangunan (right to build, a renewable term), Hak Pakai (right to use, available to foreigners) and Hak Sewa (lease).

A certificate names one of these and the whole value of the asset follows from which. Rendering any of them as "ownership" destroys the meaning, so we keep the Indonesian term with a plain gloss.

Foreigners cannot hold freehold

A foreigner cannot hold Hak Milik. The common workarounds — a nominee arrangement with an Indonesian citizen, or holding through a PT PMA foreign investment company — have very different legal standing.

A nominee agreement is unenforceable under Indonesian law, and a file resting on one is exposed. We translate the arrangement as written rather than smoothing it over.

The certificate, and the girik

A registered title is a sertipikat from the BPN land agency with a parcel number and a surat ukur survey letter.

But a great deal of Indonesian land is still unregistered and held on girik or petok D — old tax records evidencing possession, not title — which must be converted through BPN. We name which the document is.

The PPAT, the NIB and the names

A transfer is made by deed before a PPAT, the land deed official, and registered at BPN. Modern certificates carry a NIB parcel identification number.
