The mandate register, which is unusual
Guatemala keeps a Registro Electrónico de Poderes at the Archivo General de Protocolos, and a power must be registered there before it can be used.
That registration is a distinct step after the notarial deed, and an unregistered power is refused even though the deed is valid. This catches people, and we translate the registration razón with the deed.
The lawyer-notary, and the protocol
A Guatemalan notary is a practising lawyer, keeps a protocol, and each instrument carries a number within the year and the notary's collegiate registration.
Copies are issued as testimonio, and a testimonio rather than the original is what circulates. We name the instrument type as printed.
Consular powers, and the diaspora
Guatemalan consulates exercise notarial functions, and with a very large US diaspora consular powers are common for property and family matters at home.
A power signed before a US notary and apostilled must be protocolised in Guatemala and then registered. We name the issuing office and the endorsements the document carries.
The DPI, and the indigenous languages
Parties are identified by DPI, thirteen digits ending in the municipal and departmental codes of registration.
Guatemala has twenty-some Mayan languages, and a signatory may speak K'iche', Mam or Q'eqchi' rather than Spanish, in which case the notarial instrument records an interpreter. We translate that recital. See our Spanish page.
