Registration, and the stamp
A Bangladeshi power authorising the transfer of immovable property must be registered under the Registration Act, executed on stamped paper of the required value, at a sub-registrar's office.
An unregistered or under-stamped power for a property transfer is refused, and the stamp value is on the face of the document. We reproduce the registration details and the stamp.
The attestation chain, for powers granted abroad
A power executed in the United States for use in Bangladesh is notarised, then attested by the Bangladesh mission, and then by the Ministry of Foreign Affairs in Dhaka, before the sub-registrar will register it.
Bangladesh is not in the Apostille Convention, so an apostille alone does nothing. Applicants discover the gap after posting the deed, which is why we name the endorsements present.
The special power, and land
Bangladeshi practice distinguishes a general power from a special power for a named act, and land matters routinely require the second with the property described by mouza, khatian and dag number.
A power that identifies the land loosely is refused. We reproduce the land references exactly rather than paraphrasing them.
The NID, and the Bengali calendar
Parties are identified by NID, ten digits on newer cards and seventeen on older ones where the first four are the year of birth.
Documents may be in Bengali or English, and a Bengali document may carry a Bangla calendar date alongside the Gregorian one. See our Bengali page.
