Two completely different regimes, three years apart

Argentina passed a heavily regulated rental law in 2020 — Ley 27.551, imposing a three-year minimum term, annual adjustment by an official index and a one-month deposit cap — and then deregulated the market by decree at the end of 2023, leaving term, currency, adjustment frequency and index to free negotiation.

So a lease signed in 2022 and one signed in 2024 are governed by opposite rules and read entirely differently. The date on the contract is the first thing a reader needs, and we put it where it cannot be missed.

Indexation, and contracts written in dollars

Argentine leases carry an adjustment clause, and which index it uses — ICL, IPC, Casa Propia, or a negotiated formula — is the most consequential clause in the document. Post-deregulation contracts frequently adjust quarterly and some are denominated in US dollars.

A translation that renders the clause loosely has removed the only thing that says what the tenant will actually pay. We translate the formula, the index name and the frequency exactly as written.

The garantía propietaria

The standard Argentine guarantee is a garantía propietaria: a third party who owns real property in the same city pledges it, and the lease attaches the property's title details and tax assessment. It is not a US-style co-signature and it is not a surety bond.

Increasingly a seguro de caución — a bond from an insurer — is used instead. The lease says which, and the guarantor's property description is part of the document we translate.

Sellado, and proof of address

Provincial stamp tax (sellado) is payable on leases and the receipt or stamp is frequently attached. A lease is also one of the commonest documents used to prove address in Argentina, and offices generally want it with a utility bill.
