Certified German Lease Agreement Translation

The Kaution is capped and held separately by law

A German Kaution is capped at three months' net cold rent — Kaltmiete, excluding service charges — payable in three instalments, and the landlord must hold it in an account separate from their own assets, bearing interest that belongs to the tenant.

It is the tenant's money throughout, protected from the landlord's insolvency. A translation calling it a security deposit without saying that misstates what it is in a financial disclosure.

Kalt, warm and the Nebenkostenabrechnung

German rent is quoted kalt (bare rent) or warm (with service charges). The tenant pays a monthly advance on Nebenkosten, and once a year the landlord issues a Betriebskostenabrechnung reconciling it, which produces a refund or a demand.

So a German tenant's actual housing cost is not the number in the rent clause, and a reader assessing affordability from the lease alone will get it wrong. We translate the distinction and the settlement mechanism.

Staffelmiete, Indexmiete and the Mietspiegel

Rent increases follow one of three routes and the lease says which: Staffelmiete sets the increases in the contract by date and amount, Indexmiete ties them to the consumer price index, and otherwise increases are limited by the local Mietspiegel comparative rent table with statutory caps.

Those are not interchangeable and they produce very different obligations. We translate the clause and name the mechanism.

Notice, and the Schönheitsreparaturen trap

Tenant notice is three months; landlord notice lengthens with the tenancy to nine months and requires a statutory ground. German leases also commonly impose Schönheitsreparaturen — decorative repairs on leaving — though rigid clauses have repeatedly been held void.
