The concordant declaration
Slovak law applies the same three presumptions as the Czech system: the husband, then a concordant declaration (súhlasné vyhlásenie) by the mother and the man before the matrika or a court, then a court determination.
The declaration may be made before the birth, and it cannot be made while a husband is presumed the father. We name which presumption the document rests on.
Denial, and the short window
A husband may deny paternity within a short statutory period, and once it runs the presumption stands. A Slovak record may therefore name a legal father who is not the biological one.
Where a court has determined paternity, the judgment must be recorded in the register and the birth certificate reissued. We name each instrument.
The rodný list, and the register
The birth entry is amended at the matrika and a rodný list reissued showing the father. The certificate reflects the current state and may not show the history.
For a filiation matter, send the declaration or the judgment as well as the reissued certificate.
The rodné číslo, and the -ová
The rodné číslo encodes date of birth and sex and does not change with filiation. We reproduce it exactly including its slash.
A daughter takes the father's surname in the feminine with -ová, unless the form without it is elected, which Slovak law permits. See our Slovak page.
