No legal separation, and divorce by agreement
Serbian law provides no legal separation. Divorce is by court, either on a joint proposal with an agreed settlement or by petition where relations are seriously and permanently disturbed.
A joint proposal must include an agreement on the exercise of parental rights and on the division of joint property, and the court approves it. So a Serbian file contains a settlement as well as a dissolution.
Mediation, and the attempt at reconciliation
Serbian family proceedings include a reconciliation attempt and, in defined cases, mediation, conducted before the substantive hearing.
A record of that attempt appears in the file and it is a procedural step rather than evidence that the couple reconciled. We name it as what it is.
The matična knjiga venčanih
The divorce is recorded in the matična knjiga venčanih, the register of marriages, and an izvod issued afterwards shows the current status.
Serbia also issues extracts on the multilingual international form under the Vienna Convention, which some offices accept untranslated. We will tell you if you do not need us.
Two alphabets, and the JMBG
Serbian is written in both Cyrillic and Latin and both are official, so a name appears one way on a judgment and another on an identity document. One name in one language in two alphabets.
