Separation exists in fact and not in law

Bulgarian law provides no legal separation as a status. Divorce is by court, either by mutual consent with a required agreement, or by petition on the ground of deep and irreparable breakdown.

A mutual-consent divorce requires an agreement on residence of the children, parental rights, maintenance, use of the family home and surnames, and the court approves it. So the settlement is part of the file.

Fault is decided, and it matters

In a contested Bulgarian divorce the court rules on fault unless the parties ask it not to, and the finding affects maintenance and the use of the family home.

So a Bulgarian judgment may contain a finding a US reader does not expect in a modern divorce. We translate it as written rather than softening it.
