The RPwD Act, and benchmark disability at 40%
India's Rights of Persons with Disabilities Act 2016 recognises 21 specified conditions and defines benchmark disability as not less than 40% of a specified disability. That 40% figure is the threshold for reservations in education and government employment and for most statutory entitlements.
So the percentage on an Indian certificate is an eligibility position under Indian law, not a clinical measure and not a US determination. We reproduce it with the condition as specified and do not characterise it.
The UDID card
India issues a Unique Disability ID — a UDID card with a number — alongside the certificate of disability, generated through a national portal. The card carries the percentage, the condition and a validity period.
Older certificates predate UDID and exist as paper issued by a state medical board. Both are genuine, and we name the issuing authority and reproduce the UDID number where present.
The certifying authority is a board, not a doctor
The certificate is issued by a medical authority notified by the state government — generally a board of specified specialists at a government hospital — and it names them and their designations.
A private physician's report is not a disability certificate in India, however detailed. Offices sometimes receive one and assume it is equivalent; it is not, and we translate each as what it says it is.
Temporary and permanent, and the review date
A certificate may state that the disability is permanent, or it may be issued for a period with a reassessment date — commonly where the condition may improve or where the holder is a child whose assessment will change.
