Iqrar, and legitimacy under Muslim law

Muslim personal law in Bangladesh recognises iqrar — acknowledgment of paternity — as a mode of establishing legitimacy where no marriage is proved, subject to conditions including that the ages make paternity possible.

It operates by raising a presumption that a marriage existed rather than by conferring filiation directly, which is not what a US reader expects from the word acknowledgment. We describe what the instrument establishes.

There is no adoption

Bangladeshi law does not provide adoption for Muslims in the sense of creating a parent-child relationship replacing the biological one; guardianship under the Guardians and Wards Act is the available route.

Hindus and others are governed by their own personal law with different provisions. A guardianship order is not an adoption order and we name the instrument and the statute.

Birth registration, and the NID

Birth registration runs through the BRIS system and local registrars, and the birth registration certificate names the parents with their NID numbers — which is what evidences a relationship.

Registration has been incomplete historically and a great many adults hold a late registration. We translate the record and its date, because the sequence is what a reader is assessing.

English, and the honorifics

Bangladeshi legal documents are largely in English, so a translation may be unnecessary — ask the office first. The nikahnama is frequently in Bangla.

Names carry honorifics and religious elements — Md., Mst., Begum — placed where a US form expects a given name, and Bangla has no official romanisation. See our Bengali page.
