No legal separation, and three ways to divorce

Romanian law provides no legal separation, but it offers three routes to divorce: by court, by notary, and — uniquely among the countries on this list — by the civil registrar at the town hall.

The registrar and notary routes require both spouses to agree, and the registrar route additionally requires no minor children. So a Romanian divorce certificate may come from a mayor's office, and that is fully effective.

The thirty-day reflection period

The administrative and notarial routes impose a thirty-day reflection period between the application and the grant, and both spouses must return to confirm.

So a Romanian file shows two dates and the divorce takes effect on the second. A reader taking the application date has the status wrong by a month.

The certificat de divorț

The registrar or notary issues a certificat de divorț rather than a judgment, and the marriage act is annotated. A court route produces a judgment that must be recorded in the same way.

The CNP, and diacritics

Romanian documents carry the CNP — thirteen digits encoding sex, century and date of birth and the county of registration — which does not change and is the cross-check.
