Invalidità civile and Legge 104 are two different findings
Italy produces two distinct determinations that are constantly conflated. Invalidità civile is a percentage from 0 to 100 measuring reduced working capacity, assessed by an INPS commission. Legge 104/1992 status is a separate finding of handicap, and article 3 paragraph 3 identifies handicap in situazione di gravità.
A person may have a high invalidity percentage and no Legge 104 recognition, or the reverse. They unlock different things — the percentage governs pensions and allowances, Legge 104 governs work leave, care leave and tax benefits. We name which document you have.
The percentages that are thresholds
The invalidity percentage matters at specific points: 33% for some benefits, 46% for protected employment placement, 67% for certain exemptions, 74% for the assegno di invalidità, and 100% with or without an accompanying-person supplement.
So the number is not descriptive, it is a threshold position, and reproducing it exactly matters more than characterising it. We do not convert it and we do not describe it as "severe" or "moderate".
The verbale, and who signed it
The determination is issued as a verbale — the commission's minute — naming the commission, its members including the INPS doctor, the date of the examination and the diagnosis. It also states whether the condition is subject to review and when.
A verbale marked for revision has a review date; one marked non-rivedibile does not. That distinction is frequently in a checkbox and it is exactly what a foreign office wants to know.
Accompagnamento, and what it is
Indennità di accompagnamento is an allowance for a person unable to walk unaided or to perform daily acts of life without continuous assistance. It is not means-tested and it is separate from the invalidity pension.
