The 2010 Constitutional Court decision
Indonesia's Constitutional Court decided in 2010 that a child born outside marriage has a civil relationship not only with the mother but with the biological father and his family, where the relationship can be proved by science or other evidence.
That decision changed the law substantially, and documents from before and after it rest on different footing. A US reader assessing an Indonesian filiation file needs to know which side of it the document sits on.
The court determination, and the catatan pinggir
Establishing the relationship requires a court determination — the Religious Court for Muslims, the District Court otherwise — which Dukcapil then records as a catatan pinggir, a marginal note on the akta kelahiran.
So the proof is a court determination plus an annotated birth act. One without the other leaves a gap, and we name each.
Itsbat nikah, the retroactive marriage confirmation
Where a marriage was religiously valid but never registered, a Religious Court may grant itsbat nikah confirming it, which retroactively regularises the children's status.
That is a different instrument from a paternity determination and it resolves a different problem. We name it, because a US reader given an itsbat nikah and told it establishes paternity is being told something inexact.
