The mother has to consent, and that is a second document
A German Vaterschaftsanerkennung is not effective on the father's declaration alone: the mother must consent (Zustimmung der Mutter), and her consent is a separate declaration requiring the same form.
So a complete German paternity file contains two instruments, and a US office given only the father's acknowledgment has half of it. Where the child is of age, the child's consent is required instead.
Where it is done, and why the Jugendamt matters
The declarations must be publicly certified, and they can be made free of charge at the Jugendamt — the youth welfare office — as well as at the Standesamt, a notary, or a court. The Jugendamt route is the commonest and produces a document on its letterhead rather than a notarial deed.
A US reader unfamiliar with the Jugendamt may read a youth welfare office document as a social services report. It is the acknowledgment, and the translation names the office and its function.
Sorgerecht is separate, and people conflate them
Acknowledging paternity does not give the father parental authority. Sorgerecht for unmarried parents requires a separate joint declaration (Sorgeerklärung) or a court order, and a father may be legally the father with no custody rights at all.
That distinction decides questions about consent to travel, to medical treatment and to a passport. We translate the instruments separately and do not let acknowledgment imply custody.
The Geburtenregister, and the name
The acknowledgment is entered in the Geburtenregister and appears as a Randvermerk. The short Geburtsurkunde may show the father in the body; the beglaubigter Ausdruck aus dem Geburtenregister shows the entry with its marginal notes and is the better document to send.
The child's surname does not change automatically — a separate Namenserklärung is needed. See our German birth certificate page.
