Riconoscimento, and the other parent's consent
Italian riconoscimento may be made in the birth declaration, before a registrar, before a notary, or in a will. Where the child is under fourteen and already acknowledged by one parent, the consent of that parent is required for the second acknowledgment; over fourteen, the child's own consent is needed.
So a file may contain the acknowledgment, a consent, and where consent was refused a court authorisation in its place. We name each instrument rather than describing the set as "paternity papers".
The 2022 decision on surnames
The Constitutional Court held in 2022 that the automatic attribution of the father's surname alone was unconstitutional. A child now takes both parents' surnames in the order they agree, or one alone by agreement.
That changes what acknowledgment does to a name: before the decision it typically added or substituted the paternal surname, and after it the outcome is what the parents agreed and the registrar recorded. We translate the entry as made and do not assume the old rule.
Annotazione, and the copy that shows it
The acknowledgment is recorded as an annotazione on the atto di nascita held by the comune, and only the copia integrale reproduces the act with its annotations. An estratto per riassunto frequently shows nothing.
This is the single commonest reason an Italian filiation packet proves less than the applicant thinks. Ask the comune for the copia integrale.
AIRE, citizenship, and the transcription
Acknowledgment by an Italian father can ground the child's Italian citizenship, which is frequently the whole purpose. Acts made abroad are transcribed into the comune of origin through the consulate, so the operative record may sit in a town the family has never lived in.
