Erkenning, and the mother's permission
Dutch erkenning is made before a registrar at any municipality, or by notarial deed, and where the child is under sixteen it requires the mother's written permission (toestemming). From twelve the child must also consent, and from sixteen the child's consent alone suffices.
Where the mother refuses, a court may substitute permission. A complete file therefore contains the acknowledgment, a permission, and sometimes a court decision, and we name each.
Erkenning is not gezag
Acknowledging a child does not give the father parental authority. Gezag is separate, and for children born before 1 January 2023 unmarried fathers had to register it in the central authority register; for children born after that date acknowledgment generally carries joint authority automatically.
So the date of birth determines whether an acknowledgment also gave custody, which is an unusually clean rule and one that a US reader will not know to check. We state the date prominently.
The surname choice, made once
On acknowledgment the parents may choose the child's surname, and in the Netherlands that choice binds all subsequent children of the same parents. Since 2024 a child may also carry both surnames.
A family whose second child has a different surname from the first therefore has an explanation in the record, and we translate the surname declaration alongside the acknowledgment.
Latere vermelding, and the BSN
The acknowledgment is recorded as a latere vermelding on the geboorteakte held by the municipality of birth, and an afschrift issued afterwards carries it. A short BRP uittreksel shows current data only.
