Ninchi, and what it does in the koseki

Japanese acknowledgment is ninchi (認知), filed at a municipal office and recorded in the koseki, the family register. It establishes the legal parent-child relationship for a child born outside marriage and it is irrevocable once filed.

The koseki is organised by household rather than by individual, so an acknowledged child may appear in the mother's koseki with the acknowledgment noted, rather than moving to the father's. The register entry states what happened and we translate it as written.

Nationality, and the 2008 decision

Japanese nationality for a child born abroad to a Japanese father and a non-Japanese mother once required that the parents marry. The Supreme Court held that requirement unconstitutional in 2008, and the Nationality Act was amended so that acknowledgment alone can ground nationality.

That matters in a great many US-Japan family files, and it means an acknowledgment made after 2008 has consequences an older reader of the law would not expect. Prenatal acknowledgment — taiji ninchi, filed before birth — is also available and is common precisely for nationality reasons.

The registers that hold the history

Japan computerised the koseki, and entries from the previous paper register may not carry over — the kaisei genkoseki (改製原戸籍) holds them. A register a family has left is a joseki.

So an acknowledgment from before computerisation may be invisible on the current koseki tōhon. If the register shows nothing, ask for the kaisei genkoseki before concluding it never happened.

The surname, and the family court

Acknowledgment does not change the child's surname or move them into the father's koseki. That requires a separate application to the family court for permission to change the surname, followed by a filing at the municipal office.
