Three presumptions, in order
Czech law establishes paternity through three presumptions applied in strict order: the husband of the mother; failing that, a concordant declaration (souhlasné prohlášení) by the mother and the man before a registrar or a court; failing that, a court determination.
The order matters. A concordant declaration cannot be made while a husband is presumed the father, so a child born during a marriage that has broken down carries the husband as legal father until that presumption is denied.
The denial period is short
A husband may deny paternity within a short statutory period of learning the facts, and once it runs the presumption stands regardless of biology, subject to a narrow exception the Supreme Court may allow.
So a Czech record may name a legal father who is not the biological one, and it is not an error. We translate the record as it stands.
Where the declaration is made, and by whom
The declaration is made before the matriční úřad, the registry office, or before a court, and it may be made before the birth. Both the mother and the man must declare.
The birth entry is then amended and a rodný list reissued showing the father. Both documents belong in a filiation packet.
The rodné číslo, and the -ová
The rodné číslo, the birth number encoding date of birth and sex, identifies each person on the record and does not change with filiation.
A daughter taking the father's surname takes it in the feminine form with -ová, so her surname differs from his by three letters. One family name. See our Czech page.
