The Civil Code equalised children
The Chinese Civil Code provides that children born outside marriage have the same rights as those born within it, and a biological father owes maintenance regardless of marital status.
There is no formal acknowledgment instrument of the European kind. Paternity is established by the birth medical certificate naming the father, by agreement, or by a court on the basis of a paternity appraisal.
The birth medical certificate is the document
The 出生医学证明 — the birth medical certificate issued by the hospital with a unique number — names the parents and is the primary evidence of parentage in China. It is what a US office should be sent.
The hukou registration that follows records the child in a household, and the father being named there is the practical consequence. Both documents belong in a filiation packet.
The paternity appraisal
A 亲子鉴定 — a paternity appraisal — carried out by a licensed judicial appraisal institution is the evidence a Chinese court relies on, and the report states the institution's licence number and the appraisers'.
A test from an unlicensed provider is not judicial appraisal whatever its accuracy. We reproduce the licence numbers, which is the first thing a reader should be able to check.
The social maintenance fee, and what changed
Registering a child outside the birth quota historically attracted a social maintenance fee, which created real obstacles to hukou registration. That fee was abolished in 2021 and registration is no longer conditioned on it.
