A Turkish court can order separation instead of divorce

Under the Turkish Civil Code a court hearing a divorce case may, where it considers reconciliation possible, order ayrılık — separation — for a period of one to three years instead of granting the divorce. The petitioner asked for a divorce and received a separation.

That is a genuinely unusual power and it produces a decree that looks like a divorce judgment and is not one. If the period elapses without reconciliation, either spouse may then seek divorce. We translate the operative order exactly, including the period set.

The MERNİS record is where status lives

Turkish marital status is recorded centrally in MERNİS, and the nüfus kayıt örneği — the population registry record — states the current status and the events that produced it, with dates.

That record is better evidence than the decree alone, because it shows the registry gave effect to the judgment. An office asking whether someone is married should be sent the registry record, and it is frequently forgotten.

The finality stamp

A Turkish judgment is not effective until it is final, and finality is shown by a kesinleşme şerhi — a finality annotation — stamped on the decree by the court. A decree without it proves a decision was made and not that it stands.

This is the commonest defect in a Turkish family-law packet sent abroad. Check for the stamp before ordering, and we translate it with the decree.

Foreign judgments have to be recognised

A divorce or separation obtained outside Turkey does not change a Turkish registry record by itself — it has to be recognised, historically by a Turkish court and since 2018 in defined cases by application to the registry directorate.
