Separacja, introduced in 1999
Poland created separacja as a distinct institution in 1999, largely as an alternative for people who did not wish to divorce. A court grants it where there has been a complete breakdown of marital life, and the marriage continues — neither party may remarry.
Where the spouses agree and there are no minor children, the court may grant separation in non-contentious proceedings, which produces a shorter and different-looking decision. We name which procedure was used.
It can be reversed, which divorce cannot
A Polish separation may be lifted by the court on the joint application of the spouses, restoring the marriage to its ordinary effects. There is nothing equivalent for divorce.
So a Polish file may contain a separation and a later order lifting it, and a US reader who stops at the separation has the status wrong. The marriage certificate with its annotations is what settles it.
Wzmianka on the marriage act
The separation is recorded as a wzmianka dodatkowa on the marriage act held by the registry office, and only the odpis zupełny — the full copy — reproduces the act with its annotations. The odpis skrócony does not.
People order the abridged copy by default, it shows a marriage with no annotation, and the office concludes nothing happened. Order the full copy.
The finality clause, and the EU certificate
A Polish judgment needs a klauzula prawomocności — a clause confirming it is final — before it is usable abroad, and a decision without it is not evidence of a settled status.

Is separacja a divorce?
No. The marriage continues and neither party may remarry. It can also be lifted by the court, which divorce cannot.

You have the odpis skrócony. Ask for the odpis zupełny, which carries the wzmianki.
My decision has no finality clause.
Then it is not usable abroad. The klauzula prawomocności is what confirms it is final.
