Certified translation of the documents that record a legal separation in Italy, including the registry annotations and endorsements that carry the legal effect and that a reader unfamiliar with the system will otherwise skip.

Separation was the mandatory road to divorce

Italy did not allow divorce until 1970, and for decades afterwards a couple had to be legally separated for a fixed period before divorce was available — three years originally, reduced in 2015 to twelve months for a contested separation and six for a consensual one.

So an Italian file almost always contains a separation and a later divorce, and the dates between them are consequential. A US reader who sees the separation and assumes the marriage ended there is reading the first half of the story.

Consensuale, giudiziale, and the negotiated route

A separazione consensuale is an agreement homologated by the court; a separazione giudiziale is a contested judgment with findings on fault and support. Since 2014 Italy has also allowed negoziazione assistita — a lawyer-assisted agreement filed with the prosecutor — and separation before the civil registrar where there are no minor children and no property transfers.

Four routes, four different-looking documents, all valid. We name the instrument and the authority rather than calling everything "separation papers", because a homologation decree and a registrar's act are not interchangeable evidence.

The annotation on the marriage act

The separation is recorded as an annotazione on the atto di matrimonio held by the comune, and a copia integrale of the marriage act shows it. An estratto per riassunto frequently does not.

This is the commonest reason an Italian separation packet is incomplete: the applicant orders the extract, it shows a subsisting marriage with no annotation, and the office concludes nothing happened. Ask the comune for the copia integrale.

AIRE, and separations abroad

Italians resident abroad are registered with AIRE and their civil acts are transcribed into the comune of origin, so a separation obtained in Italy may need to be traced through a comune the person has never lived in. A foreign divorce is likewise transcribed rather than reissued.
