No legal separation, and divorce through the family court
Iranian law provides no legal separation. Divorce runs through the family court, and a husband's right to divorce is subject to a court process including a referral to arbitration and, in most cases, a certificate of impossibility of reconciliation.
So an Iranian divorce file contains an arbitration referral and an arbitrators' report as well as a judgment. Those are procedural requirements and we translate each as what it is.
Mahr, and why it dominates the file
The mahr — the dower stipulated in the marriage contract, frequently expressed in gold coins — becomes payable on divorce, and enforcement of it is a very large part of Iranian family litigation.
So an Iranian divorce file is often mostly about the mahr, with instalment orders and enforcement proceedings. A US reader reading it as a property dispute is close but not exact, and we translate the term and describe the instrument.
Delegated divorce, in the marriage contract
The Iranian marriage contract contains standard conditions the parties may accept, including a delegated right of divorce to the wife on stated grounds, and whether those boxes were signed changes what routes are available.
