Scheiding van tafel en bed
The Dutch institution is scheiding van tafel en bed — literally separation from table and bed — granted by the court on the same ground as divorce, an irretrievable breakdown. The marriage continues and neither party may remarry.
It is used chiefly by people with a religious objection to divorce and by couples wanting to preserve certain pension or insurance positions. After three years either spouse may ask for it to be converted into a divorce.
It has to be registered to take effect
A Dutch separation only takes effect against third parties once it is entered in the huwelijksgoederenregister, the matrimonial property register at the court, and recorded in the civil status records.
A decree that was never registered has limited effect, and that is a real defect rather than a formality. We translate the registration entry alongside the decree where the client has it.
Latere vermelding on the marriage act
The civil status effect is recorded as a latere vermelding on the marriage act held by the municipality, and an afschrift of the act issued afterwards carries it.
A short uittreksel from the personal records database shows current status only. As everywhere, the short document is the one people have and the long one is the one that proves the history.
Registered partnership, and the flitsscheiding
The Netherlands has geregistreerd partnerschap, which is close to marriage in effect but can be ended without a court where there are no minor children and the parties agree — by an agreement lodged with the registrar.
The so-called flitsscheiding, converting a marriage into a partnership in order to end it quickly, was abolished in 2009, so files from before then may show that sequence. We name each instrument for what it is. See our Dutch marriage certificate page.
